    Introite Terms of Service

    Parties to the Agreement

    The parties to this agreement are Introite, a provider of internet hosting services (hereinafter referred to as Introite), and the user of the service (hereinafter referred to as the customer).

    Subject of the Agreement

    This agreement defines the customer's right to use Introite’s servers under the terms and conditions outlined below. The customer agrees to use Introite’s services in compliance with these terms.

    Responsibilities of Introite

    • Introite provides server hosting services to the customer.
    • The services will be delivered in a manner deemed appropriate by Introite.
    • Introite is responsible for the functionality of its network and will repair faults as quickly as possible during regular business hours.
    • Temporary service interruptions may occur, with prior notice given by email or post whenever feasible, using the contact details provided by the customer.
    • Introite has the right to back up data or transfer customer-published information to another medium.
    • Introite is liable for damages caused by its own negligence, up to an amount equivalent to one (1) month's of the customer’s fixed monthly fees.
    • Introite is not liable for third-party content or services accessed via the internet or for disruptions caused by third parties.
    • Introite is not responsible for errors in consulting services.

    Responsibilities of the Customer

    • The customer is responsible for all equipment, connections, and software required for internet use.
    • Reselling or sharing the purchased hosting service with third parties is prohibited. Introite provides separate programs for resale purposes.
    • The customer is prohibited from publishing, distributing, or selling erotic material via the purchased hosting service.
    • The customer is responsible for all activity conducted through their hosting account, including any content published.
    • The customer is responsible for their own data backups. Introite is not liable for information loss.
    • The customer must safeguard their username and password, ensuring that they are not disclosed to unauthorized persons.
    • The customer may not use personal server applications or unauthorized software on Introite's servers.
    • The customer may be held liable for damages if their actions disrupt server operations or facilitate unauthorized access resulting in damage.

    Payments, Billing, and Payment Terms

    • The customer pays an activation fee and usage fees according to the prevailing price list.
    • Payments are made annually in advance via invoice or credit card.
    • Any billing errors must be reported immediately.
    • Payments must be made by the due date on the invoice. Late payments will incur statutory interest, and reminders will incur a fee of €8.00 for companies and €5.00 for private individuals.
    • Changes to billing addresses must be reported via email, phone, or in writing.
    • Introite may adjust pricing if the customer generates significantly more traffic than usual.
    • Paid usage fees are non-refundable.

    Changes to Terms of Service

    Introite reserves the right to modify services or pricing immediately if deemed necessary. Major changes must be communicated to the customer at least 30 days in advance.

    Formation and Duration of the Agreement

    The agreement is formed when the customer places an order verbally, in writing, or electronically, and Introite accepts the order by providing connection details or partially delivering the service. The agreement is valid indefinitely unless stated otherwise, with a standard contract term of 12 months. Contracts renew automatically unless terminated at least 30 days prior to renewal.

    Termination of the Agreement

    Termination must be notified in writing by post or fax at least 30 days before the new contract period begins. Introite will confirm termination via email or post.

    Transfer of the Agreement

    Introite may transfer the service to a third party without the customer's consent. The customer may not transfer the service without Introite's consent.

    Right of Withdrawal

    In accordance with the Consumer Protection Act, the service does not have a 14-day right of withdrawal.

    Domain Name Conditions

    • The customer must review and accept the specific terms of domain name registries, available on their websites.
    • Introite registers domain names on behalf of the customer via third-party registries and acts as an authorized agent for payments.
    • The customer is responsible for ensuring the correctness of the provided registration details and for having rights to the registered domain.
    • Registrations in violation of laws, regulations, or terms may be rejected or cancelled by the relevant authorities, and fees are non-refundable.
    • Introite may renew domain names on behalf of the customer but is not obligated to do so.
    • The customer must ensure their domain name does not expire.
    • The customer is fully responsible for successful domain name transfers and must confirm their completion.
